Equal Pay for Equal Work

The President recently signed the 2009 federal Lilly Ledbetter Equal Pay Act.  This new law removes past obstacles to women recovering damages for past pay discrimination. 

Wage discrimination is prohibited by both the Equal Pay Act and Title VII of the Civil Rights Act.  Jobs and job descriptions do not have to be identical for the law to require pay equality. If two employees are actually doing the same work, it doesn't matter if their titles or job descriptions differ. What counts is the duties the employees actually perform. In general, the courts have ruled that two jobs are equal for the purposes of the Equal Pay Act when both require largely equal levels of skill, effort, and responsibility and are performed under similar conditions. 

The law also requires that benefits, not just pay, be equal. Furthermore, the law protects from retaliation employees who assert their rights, or the rights of their co-workers, to equal pay.
